SUMMARY OF POSITION:
As an Associate Attorney at McCarthy & Holthus, you will play a crucial role in our legal team with a focus on bankruptcy, compliance, eviction, litigation, real property, and legal support services within the financial industry. You will provide expert counsel and representation in bankruptcy cases, ensure adherence to regulatory requirements, handle landlord-tenant disputes, manage various litigation matters, and oversee legal issues related to real estate transactions. Additionally, you will offer comprehensive legal support tailored to the financial sector, including documentation and due diligence. This position requires strong expertise in these areas, exceptional analytical and communication skills, and a dedication to delivering high-quality legal services.
Description of Duties:
- Manage legal aspects of the firm’s litigation practice.
- Portfolio management of an average of 50-75 active litigation cases focusing on pretrial practice, trial practice, and appellate practice with an emphasis on case oversight, strategic planning, client communication, document management, risk assessment, and settlement negotiations.
- Serve as lead counsel during stages of litigation focusing on pre-litigation, pleadings, discovery, trial preparation, trial attendance, post-trial, and appeals.
- Guide operational staff in implementing procedural changes and approve these changes as needed.
- Additional duties and responsibilities may be assigned based on the firm’s needs and on your career development/progress.
Experience and Skills:
Required-
- Juris Doctorate from an accredited law school
- License to practice law in Texas
- 3-5 years of experience as lead counsel representing financial institutions in contested litigation

- Admission to practice before all four Texas federal districts
- Exceptional verbal and written communication skills
- Superior organizational skills
- Proficiency in legal research applications such as Westlaw, LexisNexis, or other related systems.
- Experience in managing contested default cases and banking litigation specific to the jurisdiction

- Work Location and Schedule
- We practice law in Arizona, Arkansas, California, Colorado, Nevada, New Mexico, Oregon, Texas and Washington. Our York, Nebraska office supports all locations. This hybrid position requires onsite presence 2-3 days per week after a 90-day training period and upon management approval.
