CapSpecialty is seeking a Senior Claims Litigation Specialist II that will be responsible for the accurate, prompt, and efficient achievement of technical outcomes on assigned claim files, both litigated and non-litigated, in the specified line of business or specialty area, and involving advanced complexity and exposure. In addition to the adjustment of claims, this position will be responsible for litigation management and vendor oversight. The Senior Claims Litigation Specialist II will provide superior service to all customers, internal and external, as well as engage in collaborative projects in support of other areas of the company, to include underwriting, finance, and accounting, actuarial, operations, and technology.
Duties/Responsibilities:
- Investigate, evaluate, negotiate, and resolve claims as assigned, including coverage and liability determinations, use of available tools and resources, communicate with various internal and external stakeholders, compliance with all legal and regulatory requirements, thorough file reporting and processing in company computer systems and applications, and management of vendors such as independent adjusters and attorneys, overall management of loss costs (loss, ALAE and ULAE) on assigned files, customer service quality, and compliance with operating guidelines and other internal procedures and processes.
- Participate in special projects or initiatives, as assigned. Provide additional assistance, analysis, guidance, and direction to department staff, other departments, customers, attorneys, and others as requested or as assigned.
- Develop and maintain an up to date personal development plan for maintaining and advancing technical skills and performance.
- Travel to meet with insureds, defense counsel, plaintiffs and plaintiff's attorneys to address critical issues involved in claims, negotiate settlements, attend mediations and trials. Travel to meet with client program principles as required.
- Other activities per the direction of the Chief Claims Officer.
Supervisory Responsibilities:
None. However, this position will serve in a mentoring capacity to other members of the team.
Core Competencies:
- Advanced technical knowledge of insurance coverage and policies, insurance law, tort law and claims handling practices and techniques for one or more lines of business.
- Highly refined skills in communicating, negotiating, organizing, analyzing, problem solving, and decision-making.
- Resiliency and ability to operate under pressure in high complexity, high risk situations; and to respond rapidly to changing work conditions and expectations.
- Ability to use basic software programs and technical applications.
- Demonstrated skills in mentoring, training, and facilitating.
Education and Experience:
- Bachelor's Degree, or equivalent. J.D. strongly preferred.
- 10+ years claims litigation experience with possession or pursuit of advanced industry certification(s) (CPCU, AIC, SCLA) preferred.
- Current Adjuster License or may require completing adjuster licensing and continuing education per various states' regulations.
Physical Demands:
- Prolonged periods of sitting at a desk and working on a computer.
- May be required to lift up to 15 lbs at times.
- Some travel required (up to 25%).
