The Vail Resorts Legal team is seeking a Senior Marketing & IT Counsel. This role will provide strategic legal advice and leadership to the Vail Resorts Marketing and IT functions. In this high-impact, high-visibility role, the Senior Marketing & IT Counsel will report to the VP & Associate General Counsel and routinely advise executive leadership, including the General Counsel, Chief Information Officer, and Chief Marketing Officer, on many of the Company’s top strategic growth priorities.
The ideal candidate for this position will have a strong background in data privacy and cybersecurity law, excellent communication and interpersonal skills, personal alignment with Vail Resorts’ core values, and a desire to learn and shape the future of the ski industry. They will be inquisitive, make connections to innovate insights, exercise sound judgment in complex situations, demonstrate excellent attention to detail, and communicate confidently and clearly with business clients at all levels of the organization. They will be able to quickly identify material risks and make recommendations based in legal analysis and business acumen. The most successful attorneys at Vail Resorts are team players who are hungry, humble, and smart.
Job Responsibilities
+ Serve as the lead attorney supporting the Company’s Marketing and IT functions;
+ Counsel cross-functional teams on data privacy, information security, consumer protection, intellectual property, regulatory, and other legal considerations through the entire lifecycle of new and existing products, including My Epic Gear, from initial idea, through launch, maintenance, refinement, and end-of-life;
+ Stay current on state, federal, and global data privacy, consumer protection, antitrust, information security and cybersecurity, and artificial intelligence legal and regulatory landscape (including GDPR, U.S. state and federal privacy legislation, TCPA, CAN-SPAM, FTC guidelines, and SEC cybersecurity rules), and support related compliance programs and policies;
+ Serve as the legal lead in the investigation of information security and cybersecurity incidents and advise on regular updates to related policies, playbooks and procedures;
+ Review marketing materials, offers, disclaimers, and claim substantiation and advise on regular updates to terms and conditions, promotions, sweepstakes, contests, and other marketing efforts;
+ Advise the Company’s Contracts team on updates to contract templates, playbooks, and policies for a wide range of technology-related agreements (including SaaS agreements, license agreements, professional services agreements, and data transfer agreements) and marketing-related agreements;
+ Prepare and present legal trainings to various Vail Resorts stakeholders;
+ Provide strategic, out-front legal thinking and insight on Vail Resorts’ strategic growth priorities;
+ Contribute broadly to the leadership of the legal department, including the potential to manage one or more direct reports; and
+ Other duties as assigned.
Job Qualifications
+ Bachelor’s degree and JD required.
+ Must have an active state bar license. If you have a non-Colorado state bar license, the successful applicant must qualify for a Colorado single-client bar license (or full Colorado bar license).
+ Minimum of 8 years of experience as a practicing attorney at a law firm, government, and/or in-house, with a focus on global privacy laws, regulations, and privacy programs.
+ Agile and flexible thinker, with demonstrated ability to learn new areas of law and the business.
+ Clear and concise communicator (written and oral) with all levels within the organization.
+ Demonstrated ability to be proactive, a team player and take responsibility for managing a variety of legal matters.
+ Exceptional organizational and time management skills.
+ Demonstrated ability to handle urgent situations with patience and diplomacy.
+ A commitment to personal leadership growth and development.
Preferred Skills
+ CIPP certification.
+ Experience with one or more of the following additional legal areas:
+ Cybersecurity law
+ Marketing and advertising law
+ Intellectual property
+ Experience leading complex cross-functional issues across an enterprise.
The expected Total Compensation for this role is $175,000 - $205,000 + annual bonus + equity. Individual compensation decisions are based on a variety of factors.
