Wage and Compliance Analyst (Green and Spiegel U.S., LLC) (Philadelphia, PA): The Wage and Compliance Analyst is responsible for engaging in in-depth case analysis, problem solving, case management, and preparation of a variety of employment-based immigration matters within the Labor Certifications Team under the supervision of the lead attorney. To this end, the Wage and Compliance Analyst will leverage an advanced understanding of the H-2B, H-1B, E-3, and H-1B1 visa categories to ensure compliance with DOL procedures and requirements and resolve complex and challenging cases. Perform initial in-depth case analysis of new H-1B, H-2B, E-3, and H-1B1 cases in conjunction with the supervising attorney to identify potential issues and ensure compliance with all Department of Labor requirements for each visa category. Conduct initial wage analysis of each case to ensure that the appropriate job code is chosen and that the job offer meets or exceeds the prevailing wage for the relevant metropolitan statistical area (“MSA”). Oversee preparation, timelines, and filing of ETA-9035/9035E Labor Condition Applications for H-1B, E-3, and H-1B1 visas to ensure proper compliance with all form requirements and work with the supervising attorney to communicate corresponding obligations and requirements to the client. Draft all USCIS forms corresponding to the H-1B, H-2B, E-3, and H-1B1 visa categories and review and edit form drafts from case coordinators on the team prior to submitting to the supervising attorney for final review. Review and edit drafts of Letters of Support, Notices of Filing, Temporary Need Letters, Job Orders, Recruitment Reports, and compliance emails from case coordinators to identify and trouble shoot any potential issues and ensure compliance with all visa category requirements. Request, analyze, and summarize all additional documentary evidence in preparation of internal audit files for timely and compliant responses to Department of Labor Deficiency Notices and Requests for Information on wage, job opportunity, and worksite requirements. Post certification compliance and document retention guidance, including reviewing, maintaining, and updating case records according to all regulatory requirements. Compile and analyze historical case data in order to draft responses to complex audit requests from the Employment and Training Administration Office of Foreign Labor Certification and the Wage and Hour Division of the Department of Labor. Engage in problem solving and draft complex case analyses in a variety of contexts including memoranda to the supervising attorney, detailed email explanations to clients for attorney review, and thorough response to Requests for Evidence from USCIS. Train and onboard new case coordinators and legal assistants on the fundamentals of each relevant visa category, processes, procedures, Department of Labor requirements, forms, and internal case management. Must have experience with the following in order to complete the above-mentioned tasks: Must have experience with the following in order to complete the above-mentioned tasks: A thorough understanding of the H-1B, H-2B, E-3, and H-1B1 visa processes; experience establishing wage levels based on job requirements; proficiency in Microsoft Office and ability to adapt quickly to firm-specific software for case management and tracking. Requires a Bachelor’s degree or foreign equivalent in any field and at least 12 months of experience as an immigration paralegal, immigration legal assistant, or related occupation working directly with H-1B, H-2B, E-3, and H-1B1 visa processes and wage determination research.
